1) Purpose - Scope - Relationship with the terms of use
These terms of sale govern product sales carried out through the medico-dentaire.com website between Centrale Médico-Dentaire and any person purchasing on the site. They complement the site's terms of use.
- The terms of sale prevail for matters relating to the sale.
- The terms of use prevail for access to and use of the site.
The site sells dental equipment and consumables. Some products may qualify as medical devices and may be subject to sales restrictions.

3) Products - Information - Availability
Essential characteristics, manuals, and visuals come from manufacturers or suppliers and are provided for information purposes. Products may be new, refurbished, or second-hand when explicitly stated.
The seller may limit quantities per order and refuse a sale in the event of regulatory non-compliance, doubt about the required professional status, or a risk to public health.
4) Professional customer / Consumer customer
- Professionals: purchases made for business purposes. Certain consumer-specific protections do not apply.
- Consumers: natural persons acting outside their professional activity. Mandatory protective rules remain applicable to them.
5) Prices - Taxes - Charges
Prices are stated in Moroccan dirhams and include taxes unless otherwise indicated. Delivery charges and additional services are specified before order validation.
The seller may change prices for the future. In the event of a manifest pricing error, the order may be cancelled with a full refund.
6) Order - Formation of the contract
The ordering process includes the cart, identification or account creation, summary, acceptance of the terms of sale, payment, and acknowledgment by e-mail. The contract is formed after the seller's confirmation and payment validation.
The seller may request supporting documents and cancel the order in case of suspected fraud, non-payment, error, or regulatory non-compliance.
7) Payment
Accepted methods: Cash on delivery, Bank transfer, Check, Credit card.
Payments are processed by secure providers. The seller does not store card data.
For professionals, any overdue unpaid amount may bear late payment interest at the applicable rate and make the remaining balance immediately due.
8) Retention of title - Transfer of risk
The seller retains ownership of the products until full payment. Risk transfers when the goods are physically handed over to the customer or their representative. For professionals, if the customer chooses their own carrier, risk may transfer upon handover to that carrier.
9) Delivery
Covered areas, indicative delivery times, and charges are specified during the ordering process. Delays caused by external circumstances, the carrier, or force majeure do not give rise to compensation, subject to applicable statutory rights.
10) Receipt - Reservations - Non-conformity
Upon delivery, the customer must inspect the parcel and the products. In case of damage or missing items, precise reservations must be made and the seller informed without delay with the relevant evidence.
Any non-conformity must be reported promptly so that an exchange, repair, replacement, or refund may be arranged where appropriate.
11) Right of withdrawal (consumers only)
Consumers: legal right of withdrawal within 7 days from receipt, or any longer period required by law, subject to the exceptions provided by the applicable texts.
Typical exceptions: personalized goods, rapidly perishable goods, unsealed software or recordings, and sterile medical devices opened or altered for hygiene and health protection reasons.
Professionals: no right of withdrawal unless expressly agreed otherwise.
12) Warranties
- Statutory warranty: legal rights relating to conformity and hidden defects under applicable law.
- Manufacturer commercial warranty: when indicated on the product sheet, together with its duration and exclusions.
The customer must use the products according to instructions and keep invoices as well as batch or serial numbers where applicable.
13) Medical devices - Traceability - Recalls
- Sales may be restricted when required by regulation.
- Traceability of batch or serial numbers and retention of documentation may be required.
- The customer must comply with advertising restrictions, safety obligations, and corrective actions.
- In the event of an alert, withdrawal, recall, or maintenance action, the customer cooperates with the seller and the manufacturer.
14) Liability
The seller is not liable for indirect damage such as loss of business, loss of data, or loss of profit. For professionals, total liability is limited, to the extent permitted, to the amount excluding tax paid for the order giving rise to the damage.
No limitation applies in cases of fraud, gross negligence, bodily injury, or where mandatory rules provide otherwise.
15) Personal data
Processing required for ordering, invoicing, fraud prevention, and traceability is carried out in accordance with the Privacy Policy and applicable law.
16) Force majeure
No party is liable for a failure caused by a force majeure event making performance impossible, such as a disaster, pandemic, administrative decision, general strike, or major network or power outage.
17) Intellectual property
The elements of the site and of product sheets are protected. Any unauthorized reproduction, extraction, or use is prohibited.
18) Governing law - Disputes
These terms of sale are governed by Moroccan law. Disputes fall under the jurisdiction of the competent courts of the Kingdom of Morocco, without prejudice to mandatory consumer protection rules.

19) Evidence - Electronic signature
Electronic records, logs, e-mails, confirmations, and compliant electronic signatures constitute evidence between the parties unless proven otherwise.
20) Changes to the terms of sale
The seller may amend these terms for legal, technical, or organizational reasons. The version applicable to the order is the one in force on the order date. Material changes are notified by an appropriate means.
